From the moment of his arrest In September 1934 until he walked to the death chamber, Hauptmann, an illegal German alien, protested his innocence in two languages. But, writes New York police reporter Anthony Scaduto in his book, "Scapegoat," Hauptmann "was rushed into the electric chair" to "punish someone, any-! one," for the crime against "the hero, Lindbergh." SCADUTO, who began researching the crime in April 1973, writes that "proof is overwhelming" that the 35-year-old German carpenter was innocent.

Hauptmann was the victim of "individual perjurers," including police, "who believed they were acting justly, morally with God on Newhouse News Service WASHINGTON "When the world reads what you have written," Mrs. Bruno Richard Haupt-mann said, "maybe I will face the reporters again and tell them what they did to us." "What they did to us" was to send her husband to death in the electric chair at Trenton, N.J., on April 3, 1936. He was convicted of the kidnaping-murder of vf 1 LUNCH DINNER MONDAY-FRIDAY MONDAY-SATURDAY VCkan Sapporo 6534 FLYING CLOUD DRIVE, EDEN PRAIRIE, MINNESOTA 55343 941-5115 "Reservations are Recommended" Senior Citizen Menus or. tr SAUNA, ANYONE? their side," Scaduto writes. Hauptmann would have been acquitted or never brought to trial Scaduto says, without official use of false or twisted evidence or the withholding of vital evidence that supported Haupt-mann's innocence.

Hauptmann, who lived in the Bronx In New York, was picked up when a $20 federal gold-backed banknote, part of the ransom paid fruitlessly for the abducted child's return, was traced to him through a neighborhood gas station. About $17,000 in similar notes were subsequently found in his garage behind his home. Hauptmann said the money had been left with him when his business partner, Isador Fisch, made a trip to Germany and died there. HAUPTMANN, who said Fisch owed him more than $17,000, said he began using the money when he heard of Fisch's death. He swore he never knew the bills were part of the Lindbergh ransom.

Scaduto presents sheaths of apparently credible evidence not used, or allegedly misused, at the trial. It Includes business ledgers Hauptmann and Fisch used; letters from Fisch's brother corroborating some of Hauptmann's statements; an employment pay-book that purportedly showed Hauptmann could not have been near Lindbergh's country estate at Hopewell, N.J., when abduction occurred, and supposedly suppressed police laboratory reports that would have helped the defense. Scaduto also said that police Ignored the "confession" of a disbarred lawyer containing evidence only the kidnaper could have known. 10-6 Sun. 12-5 A plan for a "bubble" over four Burnsville High School tennis courts is stalled temporarily on a legal question. Floyd Hiar, 32 River Woods Lane. Burnsville, has proposed building the bubble over four of the high school's eight courts at no cost to the school. The school district would be guaranteed a certain number of court hours for school purposes, and Hiar would rent the other time to the general public.

The question is whether the district would have to count the guaranteed court time as income and apply an equivalent amount to repay the district bonds, said Superintendent Robert Tschirki. The guaranteed time could be worth up to $6,000 annually using present rental rates for all-weather courts In the area, he said. The district has decided to seek an attorney general's opinion about whether the court time would be considered income, Tschirki said. mm 0 (1 A A hristams is Do Dexter people have more fun?
