The comment came from Frank Keyes, executive secretary of the county organization, in testimony before a house judicial subcommittee on court reform. The legislative group is considereing creation of a statewide county court system. Keyes urged the lawmakers to adopt a "generous attitude" toward small rural counties and their concerns. He said his organization had not taken a position on the court reform proposal.

But in talks with many county commissioners, Keyes said some are concerned about lack of facilities and the cost of providing additional quarters. "Counties with declining population and tax base," he said, "should not be forced into capital expenditure." The witness suggested, too, that some District Court judges are "to autocratic" to agree to sharing their courtroom facilities. Rep. Howard Albertson of Stillwater agreed that county boards should have a piece of the action," but he suggested that commission ers have not been responsive to change. Albertson said proposals to combine county offices have met such reac tion it was like "trying to tear down a church.

The high court dismissed the City attorney's appeal of a St Paul Municipal Court order to return the books after a charge against the co-owner, Robert O. Carlson, was dismissed on grounds the prosecution had failed to prove its case.

White Bear Marine Dies in Vietnam A White Bear Lake Marine was killed in an accidental explosion of a recoil- less rifle in Vietnam, the Defense Department reported today. He was identified as Pfc. Jerry N. Ellis, 20, son of Mr.

and Mrs. Frank B. Ellis, 423 Sandra Lane, White Bear Lake. A 1966 graduate of White Bear High School. Pfc.

Ellis died on July 4 while serving with the 1st Marine Division in Thua Thien Province. He had attended Anoka- Ramsey Junior College for one year before entering the service in 1967.
